Refund policy


This document sets out the various situations where the Buyer may return the Products and be refunded by trendyfair.com. The terms used herein below have the meanings as defined in the General Terms.
 
1  Cancellation/Complaints/Returns
 
1.1 Non-receipt and late delivery of Products
 
If the Buyer does not receive the ordered Products within fifteen (15) days after receipt of the Seller’s Product by trendyfair.com, or, in the case of Products sold by trendyfair.com directly, if the Buyer does not receive the ordered Products at the agreed Delivery Date, the Buyer will be entitled to cancel his Order even after the cooling off period has expired (if applicable) by sending a registered letter with an acknowledgement of receipt to the following address: 40-42 Washington Street, 1st District, Bucharest, Romania or an e-mail to the following address: support@trendyfair.com.
In the above mentioned cases, trendyfair.com will refund the Buyer within a maximum of fifteen (15) days from the date the registered letter with acknowledgement of receipt/the e-mail is received.
Please note that if the Buyer receives his/her Products after they have already cancelled the Transaction, trendyfair.com will refund the Price of the Product(s) returned, the Shipping Cost (if the entire Order is being returned) and the cost of postage for returning the Order to trendyfair.com within a maximum of fifteen (15) days from the date trendyfair.com receives the complete Product in its original condition.
Following cancellation, the Buyer may choose to obtain a refund by way of a credit to his/her payment card or PayPal account, in each case under the condition that trendyfair.com does not consider the cancellation/refund request regarding the total or partial non-receipt of an ordered Product to have been made fraudulently.  In case of partial cancellation, only the cancelled part of the Order will be refunded.
 
1.2 Receipt of Products by trendyfair.com from the Seller that do not conform with the Product Information
 
If trendyfair.com discovers during quality checks that a Product does not match the Product Information provided by the Seller, then:
            - in the case of Products that partially match their description, trendyfair.com shall on behalf of the Buyer (i) negotiate with the Seller in order to reduce the Price; or (ii) cancel the sale and refund the Buyer, in accordance with the Buyer’s option; if the Buyer and Seller agree to a price reduction, the Buyer’s payment card or PayPal account will be credited; or
            - in the case of Products that substantially do not match their description, that are counterfeit or forbidden, trendyfair.com shall directly cancel on behalf of the concerned Buyer the sale and refund the Buyer.
If the Buyer’s Order is cancelled, the Buyer may choose to obtain a refund by way of a credit to his/her payment card or PayPal account; in case of partial cancellation, only the cancelled part of the Order will be refunded within fifteen (15) days as of the date of when the Buyer’s Order was cancelled.
 
1.3 Receipt of Products by the Buyer that do not conform with the Product Information
 
For purchases from trendyfair.com, when trendyfair.com sells its own Products directly via the Site, if a Product received by a Buyer does not match its description in the Product Information or breaches the General Terms, the Buyer shall be entitled to submit a complaint within a maximum period of two (2) years as from the date of reception of the Product.  When addressing a complaint, the Buyer shall be entitled to request, alternatively:
          - free of charge repair;
          -free replacement of the respective Product with such other goods, which meet the agreed requirements;
          -full refund of the price paid; or
          -corresponding reduction of the Price.
In case trendyfair.com agrees to repair the defected Product or replace it with a new one, the Buyer shall not be able to claim any of the remedies under items (iii) and (iv) above.
If a complaint is found grounded, trendyfair.com shall reimburse the Buyer any expenses incurred by the latter in relation to the performed remedy of the established non-conformity, including but not limited to costs for shipment (including for the return of the Product), materials or labour.
If trendyfair.com fails to satisfy the complaint within the term agreed and provided said complaint is sufficiently grounded, the User is entitled to rescind the Transaction with respect to the respective Product and to claim full refund of the Price paid, or to claim reduction of the Price with respect to the defective Product(s), except for where the non-conformity of the Product is insignificant.
In cases of refund of the Price, trendyfair.com guarantees a repayment of the amount paid, subject to the condition that if a part of the Price was paid by means of discounts accumulated in the Account, the Buyer will be refunded the money actually paid by the same, and the Customer's Account will be credited with the discount.  The Shipping Cost incurred by the Buyer shall be returned by trendyfair.com.
Where Buyers have failed to take reasonable care of the Products, whilst in their possession or when returning them, trendyfair.com reserves the right to refund the Buyer a reduced Price due by way of compensation.
Any Products returned in a condition where the cost of repair or cleaning would be disproportionate compared to the Price of the Product will (unless received by the Buyer in such condition) not be refunded and will be kept at the Buyer’s disposal on his/her own risk for a period of six (6) months after trendyfair.com receives the Product.
If a Buyer receives an apparently counterfeit Product or a Product that appears to have been banned from sale, the Buyer may return the Product to trendyfair.com and receive a refund, except in the event of fraud of the Buyer.
 
1.4 The right of the Buyer to withdraw (Cooling-off period)
 
For purchases from trendyfair.com, when trendyfair.com sells its own Products directly via the Site:
The Buyer (natural person) has the right to notify in writing trendyfair.com that he/she withdraws from a sale, without owing any compensation in connection thereto and without giving any reason whatsoever within 14 (fourteen) days from the date of the receipt of the respective Product.
In case the Buyer exercises his/her right to withdraw from a Transaction (i.e., not to buy the ordered Product any longer), he/must return the received Product immediately, but in any case not later than within fourteen (14) days as of receipt of the Product from trendyfair.com.
In the case of withdrawal, the Buyer will be refunded the full amount actually paid by him/her (including the costs for the shipment of the Product to the Buyer) within fifteen (15) days from the date of the withdrawal notification, term which may be extended by trendyfair.com until the date trendyfair.com receives the returned Product (if the case).  The Shipping Costs for the return of the Product to trendyfair.com will be borne by the Buyer.
 
2 PROVIDING MISLEADING INFORMATION 
 
A Buyer’s Order may be refused if the information provided is deliberately misleading and/or fraudulent (e.g. the Buyer indicates an address that does not exist).  In this case, the Buyer will be notified via email of the actions taken by trendyfair.com, which will automatically refund the value of the Order if the Buyer has already paid.
 
3 UNAVAILABILITY OF A PRODUCT 
 
In the event the Buyer places an Order for a Product which proves to be unavailable for any reason whatsoever after the Order is confirmed, trendyfair.com will promptly contact the Buyer to offer him/her to cancel the Order and if payment has been already collected, provide a refund to the Buyer.
Furthermore, trendyfair.com shall refuse an Order for a Product for which a material error has been made as regards its sale Price.  In this particular case, the Buyer will be notified via email of the actions taken by trendyfair.com which will automatically refund the value of the Order if the Buyer has already paid.
