HOW TO BUY PRODUCTS

The definitions of the terms used in this document and the procedure of Registration on the Site are provided in the General Terms, that this document is part of and which all Buyers are invited to read carefully before visiting or using the Site.

1 HOW to ORDER a product
 
1.1 Placing an Order
 
A Buyer wishing to purchase a Product as described in the Product Information may click on the “Add to Shopping Bag” button in the Product Information page.  The Buyer may add to his/her Shopping Bag several Products without limitation.
Please note that the Products may be shipped only to the places indicated in Section 3.  If the Buyer specifies in the shipping details other places than those expressly stipulated under Section 3, the Order placed on the Site shall be considered void and shall have no effect.
The Price of a Product does not include Shipping Costs, customs duties or other additional expenses, which shall be additionally invoiced.
Before any Transaction is closed, trendyfair.com shall ask for the explicit consent of the Buyer with regard to any additional payment to the amount already agreed with trendyfair.com.
All the relevant information related to the Products shall be provided by the Sellers in English.  In addition, the Product Information page indicates whether the Product that is listed for sale is owned by trendyfair.com or by a Seller.
 
1.2 Closing a Transaction
 
The following steps have to be followed before a Transaction is concluded between the Buyer and the Seller or between the Buyer and trendyfair.com, when trendyfair.com sells its own Products directly via the Site:
  1. -the Buyer adds the Product(s) to the Shopping Bag using the “Add to Shopping Bag” button;
  2. -the Buyer places his/her Order for the selected Product(s) by pressing the “Complete your Order” button at the end of the check-out process;
  3. -immediately after placing the Order, the Buyer will see an on-screen acknowledgement of his/her Order; trendyfair.com will also send to the Buyer an email acknowledging the Product that he/she has ordered and the total cost of the Order;
  4. -trendyfair.com dispatches the Product to the Buyer.
In order for the Transaction to be duly executed, before placing an Order, the Buyer must provide his/her accurate contact details, as follows:
  1. -surname, first name and, if appropriate, the surname and first name of the person to whom the Product is to be delivered, if different;
  2. -the delivery address, which must be accurate and complete to allow and facilitate the shipping of Orders; and 
  3. -a valid phone number.
trendyfair.com shall ship the ordered Products to the Buyer by DHL.
 
2  Payment of the ordered product(s)
 
The Price and Shipping Costs of the ordered Product(s) shall be paid by the Buyer via PayU or PayPal.
To use the PayPal payment system, the Buyer will need a PayPal account; the Buyer will then be bound by PayPal’s General Terms of Use which may be viewed via the PayPal Site by choosing the appropriate country on the following page: www.paypal.com.  Please note that PayPal’s General Terms of Use may be different for Buyers in different countries.
The payment of the ordered Product(s) may be performed only by the cardholder, as trendyfair.com is 3D Secure enabled. The 3D secure is an authentication service that allows only the cardholder to use the card when shopping online, by entering their previously selected PIN/Password or a One Time PIN to help their bank to know it is them shopping online.
By using the 3D Secure service the credit cards can be protected against unauthorized use when shopping online. The 3D Secure program aims to build consumer confidence and trust by offering a more secure online purchasing experience.
 
3 Shipping costs and areas
 
The Shipping Costs are a contribution of the Buyer to the costs incurred by trendyfair.com (shipping, insurance or other costs, etc.) for the shipping of the Products to the Buyer.  The Shipping Costs will be calculated for every ordered Product and will vary depending on the dimensions, weight and location of the ordered Product.  Trendyfair.com will notify the Shipping Costs to the Buyer in order for the Buyer to know the final cost of the Order, namely the total amount representing the Price of the Products and the related Shipping Costs, before completing the Order.
The Shipping Costs apply to the Products sent from the logistics centre located in Bucharest to the relevant area in the world. Customs duties, if any, are borne by the Buyer directly.
 
4  Notifications related to the payment
 
Trendyfair.com shall notify the Buyer and the Seller via email of its receipt of payment from the Buyer.  Such email or any payment receipts sent to the Buyer shall not be considered, under any circumstances, an acceptance of the Buyer’s Order.
The information related to the Buyer’s Order shall be processed to validate the Order, prior to the shipment of the Product.
A Buyer’s Order may be refused if the information provided is deliberately misleading and/or fraudulent.  In this case, the Buyer will be notified via email of the actions taken by trendyfair.com, which will automatically refund the value of the Order if the Buyer has already paid.
 
5  Delivery of the products
 
In case of Orders for Products owned by trendyfair.com, when trendyfair.com sells its own Products directly via the Site, an anticipated delivery date will be specified in the Order summary provided to the Buyer (the “Delivery Date”).
In case of Orders for Products for which trendyfair.com is acting as an agent for the Seller, the date when the Product can be dispatched to the Buyer will vary depending on the date when trendyfair.com receives the Product from the Seller.  Therefore, trendyfair.com can not commit to a specific delivery date.  However, in case of such sales, the Shipping Date will be no later than fifteen (15) working days after receipt of the Seller’s Product by trendyfair.com.
Please see Section 7.1 “Non-receipt and late delivery of Products” for further information regarding cancellation for late or non-receipt of an Order.
The Products shall remain in the Seller’s property or in the property of trendyfair.com, when trendyfair.com sells its own Products directly via the Site, until trendyfair.com collects the full Price of the Order from the Buyer, including any taxes and Shipping Costs.  The risk of damage and loss of a Product sold to the Buyer shall pass to the Buyer on the date of receipt of such Product.  The Buyer shall therefore be liable for any damage caused to the Product that is the Buyer’s fault following receipt.
 
6 Product Unavailability/Refusal of Orders
 
In the event the Buyer places an Order for a Product which proves to be unavailable for any reason whatsoever after the Order is confirmed, trendyfair.com will promptly contact the Buyer to offer him/her to cancel the Order and if payment has been already collected, provide a refund to the Buyer.
If the Buyer chooses to cancel the Order, the amounts paid by the Buyer will be refunded to the Buyer within fifteen (15) days of the date the Buyer indicates that it chooses to do so.
Trendyfair.com shall not refuse to any Buyer the purchase of any Product without a justified reason, according to the law.  Nevertheless, trendyfair.com reserves its right to refuse an Order from a Buyer with whom a dispute exists regarding the payment of a previous Order.
Furthermore, trendyfair.com shall refuse an Order for a Product for which a material error has been made as regards its sale Price.  In this particular case, the Buyer will be notified via email of the actions taken by trendyfair.com which will automatically refund the value of the Order if the Buyer has already paid.
 
7  Cancellation/Complaints/Returns/Refunds
 
None of the provisions set out in this section shall affect the Buyer’s statutory rights.
 
7.1 Non-receipt and late delivery of Products
 
If the Buyer does not receive his/her Products within fifteen (15) days after receipt of the Seller’s Product by trendyfair.com, or, in the case of Orders for Products own by trendyfair.com and directly sold via the Site, if the Buyer does not receive his Products at the Delivery Date, the Buyer will be entitled to cancel his Order even after the cooling off period has expired (if applicable) by sending a registered letter with an acknowledgement of receipt to the following address: Washington Street, no. 40-42, 1st District, Bucharest, Romania or an e-mail to the following address: support@trendyfair.com.
Trendyfair.com will refund the Buyer within a maximum of fifteen (15) days from the date the registered letter with acknowledgement of receipt/the e-mail is received.
Please note that if the Buyer receives his/her Products after they have already cancelled the Transaction, trendyfair.com will refund the Price of the Product(s) returned, the Shipping Cost (if the entire Order is being returned) and the cost of postage for returning the Order to trendyfair.com within a maximum of fifteen (15) days from the date trendyfair.com receives the complete Product in its original condition. Any such returns shall be made in accordance with Section 7.4 below.
Following cancellation, the Buyer may choose to obtain a refund by way of a credit to his/her payment card or PayPal account, in each case under the condition that trendyfair.com does not consider the cancellation/refund request regarding the total or partial non-receipt of an ordered Product to have been made fraudulently.  In case of partial cancellation, only the cancelled part of the Order will be refunded.
 
7.2 Products that do not conform with the Product Information
 
            7.21  Receipt of Products by trendyfair.com from the Seller that do not conform with the Product Information
  1. -If trendyfair.com discovers during quality checks that a Product does not match the Product Information provided by the Seller, then:
    1. in case the Products partially match their description, trendyfair.com shall, on behalf of the Buyer, (i) negotiate with the Seller in order to reduce the Price; or (ii) cancel the sale and refund the Buyer, in accordance with the Buyer’s option; if the Buyer and Seller agree to a price reduction, the Buyer’s payment card or PayPal account will be credited; or
    2. in case the Products substantially do not match their description, they are counterfeit or forbidden, trendyfair.com shall directly cancel on behalf of the concerned Buyer the sale and refund the Buyer.
  2. -If the Buyer’s Order is cancelled, the Buyer may choose to obtain a refund by way of a credit to his/her payment card or PayPal account; in case of partial cancellation, only the cancelled part of the Order will be refunded.
             7.2.2  Receipt of Products by the Buyer that do not conform with the Product Information
  1. -For purchases from trendyfair.com, when trendyfair.com sells its own Products directly via the Site, if a Product received by a Buyer does not match its description in the Product Information or breaches the General Terms, the Buyer shall be entitled to submit, within a maximum period of two (2) years as from the date of reception of the Product, a request to trendyfair.com in order to exchange the Product, obtain a refund or (where possible at reasonable cost) a repair of the Product, at the Buyer’s option.  As regards the return of Products that are new, the Buyer may instead choose to request a replacement for the Product, where such replacement is appropriate and where the costs of doing so are not disproportionate when compared to that of a repair.
If a complaint is based on the non-conformity of the Product with the Product Information and/or the General Terms, the Buyer shall be required to return the Product in accordance with Section 7.4 below.
Trendyfair.com undertakes that if a Product is returned by a Buyer because it does not match its Product Information or breaches their obligations under the General Terms and/or statutory obligations, then trendyfair.com may not refuse to provide the Buyer with a refund (including the Shipping Cost of the Order), to repair the Product (if reasonably possible) or, in the case of new Products, to replace the Product, at the Buyer’s option and in each case must do so within a reasonable time.
  1. -If a Buyer receives an apparently counterfeit Product or a Product that appears to have been banned from sale, the Buyer may return the Product to trendyfair.com and receive a refund, except in the event of fraud of the Buyer.
Trendyfair.com shall not be liable for the failure of any Seller (for which it acts as an agent) in fulfilling the Seller’s obligations under the General Terms, and in particular where a Seller fails to provide a refund or other remedy for any Products returned by the Buyer that do not conform to the description provided in the Product Information.
 
7.3 The right of the Buyer to withdraw (Cooling-off period)
 
      7.3.1 For purchases directly from trendyfair.com
This Section 7.3.1. refers to the right of Buyers (natural persons) to withdraw from a Transaction with trendyfair.com as per the compulsory provisions of the Romanian Emergency Ordinance no. 34/2014 regarding the consumers rights in contracts concluded with professionals.
The Buyer (natural person) has the right to notify in writing trendyfair.com by using the withdrawal form available at the link http://www.trendyfair.com/uploads/docs/withdrawal-form.pdf, that he/she withdraws from a sale, without owing any compensation in connection thereto and without giving any reason whatsoever within 14 (fourteen) days from the date of the receipt of the respective Product.
The Buyer shall not be entitled to withdraw from a Transaction concerning:
  1. -a Product whose price depends on the fluctuations in the financial markets which are not in the control of trendyfair.com;
  2. -a Product made as per the instructions of the Buyer or tailored to his/her needs;
  3. -a Product which, by its nature, is subject to deterioration or expires rapidly;
  4. -a Product that is sealed for reasons of health protection or hygiene and the Buyer has unsealed it;
  5. -a Product which contains elements which, after delivery, have mixed together and cannot be un-mixed;
  6. -audio or video recordings or computer software after the removal of their original packaging by customer;
  7. -newspapers, magazines and other periodicals.
In case the Buyer exercises his/her right to withdraw from a Transaction (i.e., not to buy the ordered Product any longer), he/must return the received Product immediately, but in any case not later than within fourteen (14) days as of receipt of the Product from trendyfair.com.
Subject to the first sentence, the Buyer must return the Product in the quantity and quality as received from trendyfair.com in unaltered condition, unless a change was necessary within the scope of ordinary management. In particular, the Product should be accompanied by all parts, accessories, instructions, conditions of use and similar documents (except for proof of purchase) that he/she received with the Product, and the original packaging, if available.  Trendyfair.com may refuse to accept Products which do not comply with the above requirements or have not been returned in the provided 14 (fourteen) days term.
In the case of withdrawal, the Buyer will be refunded the full amount actually paid by him/her (including the costs for the shipment of the Product to the Buyer) within fifteen (15) days from the date of the withdrawal notification, term which may be extended by trendyfair.com until the date trendyfair.com receives the returned Product (if the case).  The Shipping Costs for the return of the Product to trendyfair.com will be borne by the Buyer.
 
      7.3.2 For purchases from Sellers
 
In case the Buyer purchases Products from a Seller, the Buyer shall not be entitled to a ‘cooling-off period’ as described in the paragraph above.  Such a Transaction is considered to be made between non professionals.  However, if a Seller is an authorized trader according to its statutory law, then such a Seller shall indicate to trendyfair.com in advance the applicable cooling-off term.
However, within ten (10) days of receipt of the Product, the Buyers who do not wish to keep the Products they have purchased may relist the Products for sale on the Site.
If a Buyer decides to relist a Product on the Site, trendyfair.com will not deduct a Commission if the relisted Product is subsequently sold via the Site.  Trendyfair.com will however deduct the relevant charges to cover shipping/packaging in respect of items that are resold on the Site.
 
7.4 Terms and conditions for the return of Products
 
Any returns shall be made to the following address: FABRICA DE STIL S.R.L., Londra Street, no. 37, Bucharest, Romania, zip code 011762, Sector 1, Bucharest, Romania.
It is recommendable for the Buyers to obtain and keep the proof of returning the Product(s) to trendyfair.com.  Please note that trendyfair.com will not be held responsible in case the Products are damaged or lost in transit.
The Buyers must take reasonable care of the Products.  All Products that are returned will be inspected on return and, in all cases, the Products must be returned in complete form (i.e., with any accessories or other parts received with the Products).
Where Buyers have failed to take reasonable care of the Products, whilst in their possession or when returning them, trendyfair.com reserves the right to refund the Buyer a reduced Price due by way of compensation.  This includes any Products that are returned damaged (where such damage has occurred following delivery to the Buyer) due to fair wear and tear, willful damage, accident, negligence by a Buyer or a third party (other than the courier contracted by trendyfair.com), use otherwise than in accordance with their intended use, failure to follow the manufacturer's or trendyfair.com’s instructions or any alteration or repair carried out without trendyfair.com’s prior approval.
Any Products returned in a condition where the cost of repair or cleaning would be disproportionate compared to the Price of the Product will (unless received by the Buyer in such condition) not be refunded and will be kept at the Buyer’s disposal on his/her own risk for a period of six (6) months after trendyfair.com receives the Product.  Buyers wishing to retrieve the Product may ask to do so by sending a letter or an email to trendyfair.com.  Following receipt of such letter or email, trendyfair.com will ship such Products back to the Buyer, at the Buyer’s expense, or the Buyer may choose any other delivery way being responsible to take over the Product from the trendyfair.com’s headquarters.
If a Buyer does not make a request to trendyfair.com for the return of his/her Product within a 6 (six) months period of trendyfair.com’s receipt of them, trendyfair.com will become the owner of any non-refundable or returned Products (as applicable) that are not claimed back.  These Products will be destroyed or given to charity if their condition allows to do so.
 
8  Direct sales made by trendyfair.com for its own products
 
When trendyfair.com makes direct sales of its own Products via the Site, trendyfair.com shall comply with its obligations as such in accordance with the General Terms and the Romanian law regarding consumers’ protection.
